Consumer Health Data Privacy Policy

This policy is for residents of Washington State (My Health My Data Act, RCW 19.373) and Nevada (SB 370), and we apply it to everyone in the United States. It covers "consumer health data": personal information that is linked or reasonably linkable to you and that identifies your past, present or future physical health. It is part of, and sits alongside, our Privacy Policy. Omir Lazzat, Dombyra 7, Almaty 050010, Kazakhstan, operates Split AI.
1. The consumer health data we collect, and why
- Body basics and goals: age range, biological sex (optional), height, weight and weight history, your goal. We use them to calculate your daily calorie and macro targets and to build your training plan.
- Limitations and diet: injuries, movement restrictions, exercises to avoid, allergies, excluded foods, dietary preference. We use them to keep unsuitable exercises and foods out of your plan.
- Training and nutrition records: workouts, sets, loads, check-ins, meals, meal photos, and the calorie and macro estimates made from them. We use them to adjust your plan and show your progress.
- Physique photos and observations (optional, adults only, only with your separate consent): front, side and back photos and the visual observations made from them, to compare your progress.
- What we work out from the above: your calorie and macro targets, plan adjustments and a short summary of your training habits that personalises coaching notes.
We collect this data only to provide the features you ask for in the App. We do not use it for advertising, and we do not collect it from any source other than you.
2. Sources
You, through the App: your answers, the photos you take, and what you log.
3. Who receives it
We do not sell consumer health data, and we do not share it with third parties or affiliates. We have no affiliates. Two service providers process it only on our instructions, under contract, to run the App for you:
- Google Cloud (Gemini on Vertex AI) analyses your photos and builds and adjusts your plan from your answers and records. Google does not use this data to train its models.
- UpCloud hosts our servers, database and photo storage in the United States.
Apple and Google receive no consumer health data when you sign in or pay.
4. Your rights
You can:
- confirm and access the consumer health data we hold about you, and get the list of everyone we have given it to, with their contact details (section 3 is that list today). Me → AI consents & data → Export gives you a copy at any time;
- withdraw consent. Turning off physique photo processing in Me → AI consents & data deletes your physique photos and observations;
- delete your consumer health data. Me → Delete account deletes your account and all of it, including from our service providers' systems; you can also ask us to delete specific data.
To use a right, use the App or email support@getsplitai.app from the email address on your account, or say which Apple or Google account you sign in with. We confirm it is you through your signed-in account and answer within 45 days. If we need longer, we tell you why, and we never take more than 45 extra days. Using your rights is free and never changes the price or service you get.
Appeal. If we refuse a request, reply to our answer with "Appeal" within 45 days. We decide within 45 days and explain why. If we still refuse, you can complain to the Washington State Attorney General at www.atg.wa.gov/file-complaint, or to the Nevada Attorney General at ag.nv.gov.
5. Changes
Before we collect a new kind of consumer health data, use it for a new purpose, or share it with anyone new, we update this policy and ask for your consent in the App where the law requires it.
